Welcome to Clarity, a digital wellness platform operated by Clarity Wellness, Inc. ("Clarity," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our platform, including our AI Recovery Coach named Clare.

By accessing or using Clarity, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

You must be at least 18 years old to use Clarity. If you are under 18, you may only use our services with parental consent and supervision.

2. Medical Disclaimer and Limitations

  • • We do not provide medical advice, diagnosis, treatment, or therapy
  • • Our services are not a substitute for professional medical care
  • • We cannot and do not guarantee any health outcomes

Professional Care: We strongly encourage you to work with licensed healthcare providers, therapists, and addiction specialists alongside using Clarity. Our services are designed to complement, not replace, professional care.

Crisis Limitations: While Clare includes crisis detection features, these are not foolproof and should not be relied upon for emergency intervention. If you are experiencing suicidal thoughts, severe depression, or any mental health crisis, immediately contact emergency services.

3. Service Description

Clarity provides digital wellness tools including:

  • AI-powered conversational support through Clare
  • Voice calling capabilities (Guardian tier)
  • Progress tracking and journaling tools
  • Peer community features
  • Educational content and recovery resources
  • Crisis detection and resource routing

Service Availability: We strive for 99.9% uptime but cannot guarantee uninterrupted service. Planned maintenance will be announced when possible.

AI Limitations: Clare's responses are generated by artificial intelligence and may not always be accurate or appropriate. Use your judgment and seek professional help when needed.

4. User Responsibilities and Conduct

You agree to:

  • Provide accurate information during registration and use
  • Maintain the security and confidentiality of your account
  • Use Clarity in a manner consistent with recovery and wellness goals
  • Respect other users in community features
  • Report any concerning behavior or content
  • Seek professional help when experiencing crisis situations

You agree NOT to:

  • Share content that promotes substance use or self-harm
  • Attempt to reverse-engineer or manipulate our AI systems
  • Use the service for any illegal activities
  • Share inappropriate or harmful content
  • Impersonate others or create false accounts
  • Rely solely on Clarity for crisis intervention
5. Privacy and Data Usage

Your privacy is important to us. Our Privacy Policy details how we collect, use, and protect your information.

Key points:

  • We are HIPAA compliant and protect your health information
  • Conversations with Clare may be analyzed to improve our AI
  • Voice calls are processed by our secure AI systems
  • We never sell your personal data to third parties
  • You can request data deletion at any time
6. Subscription and Billing

Subscription Tiers:

  • Foundation (Free): Basic features with limited daily usage
  • Coach ($7.99/month): Unlimited text interactions and advanced features
  • Guardian ($19.99/month): All features including voice calling

Billing: Paid subscriptions are billed monthly and automatically renewed unless cancelled. You may cancel at any time through your account settings.

Refunds: We offer prorated refunds for cancelled subscriptions within 30 days of initial purchase.

7. Limitation of Liability

IMPORTANT: To the fullest extent permitted by law, Clarity shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for all damages shall not exceed the amount you paid to Clarity in the 12 months preceding the claim.

Health Outcomes: We make no warranties about health outcomes, recovery success, or the effectiveness of our platform for any individual's specific needs.

8. Crisis and Emergency Procedures

IF YOU ARE EXPERIENCING A MENTAL HEALTH CRISIS:

  • • Call 988 (Suicide & Crisis Lifeline)
  • • Call 911 for immediate emergency services
  • • Go to your nearest emergency room
  • • Contact your healthcare provider immediately

While Clare includes crisis detection features, these are supplementary tools and should not be relied upon as primary crisis intervention. We are not responsible for emergency response or crisis intervention.

9. Account Termination

Your Right to Terminate: You may delete your account at any time through your account settings.

Our Right to Terminate: We may suspend or terminate your account if you violate these Terms, pose a risk to other users, or for any other reason at our discretion.

Effect of Termination: Upon termination, your access to paid features will cease, but we will retain certain data as required by law or our Privacy Policy.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use of Clarity after changes constitutes acceptance of the new Terms.
